Job Description

TP Appeal & Specialized Claims Litigation Management: -


  • Responsible for specialized claims litigation of more than 6783 claims/litigation and 2138 claims/litigation of TP Appeals pending before various courts North Zone.
    Management of Appeal & Specialized Claims litigation teams at North Zone and Locations, guiding for necessary compliance and decisions for best results.
    Responsible for executing a proper line of action in all speciated litigation and TP Appeal at locations in collaboration with team, advocates, local team of LOBs.
    Regular analysis on the TP Appeal and consumer litigation trends at High Courts, District Commission, State Commission, National Commission, Ombudsman, Civil Courts, Arbitration, and Supreme Court trends sharing the same to the NORTH ZONE and other stake North Zone for change in decisions on applicable defenses from time to time
    Responsible for assistance guidance to Penal Advocates, Team for Specialized Claims and TP Appeal
    Responsible for creation of SOPs/SLAs for Claims Legal and collaboration with LOBs for best results.
    Maintaining TAT for Compliance, Filing of appeals etc.
    Responsible for production of timely updating of reports and liaison with other functional areas for purposes of data sharing
    To ensure to comply with all applicable laws/regulations, as well as company policies/procedures.
    Responsible for driving the technological enhancements and automation to improve claims management, settlement and processing.
    Be abreast with the latest case laws and precedents in order to arrive at a judicious decision while defending a claim or suggesting for compromise or for compliance of an award.
    Monitor new judgments/ updates in existing judgments passed by legal system to evaluate their impact on BAGIC\xe2\x80\x99s business and prepare for managing it.



Specialized Claims Litigation Management: -

  • Co-ordination with other LOBs for filing reply, affidavits, evidence within stipulated time limit stipulated by law In Specialized Claims.
    Decisions on award passed by courts in Specialized Claims litigation.
    Provide guidance and support to LOBs for consumer claims litigation, procedures, claims handling, and data in assigned jurisdictions.
    Approval of Reply, Affidavits, Argument and Self-Contained Notes (SCNs) to be filed before the various courts including High court, Consumer forums, District Courts and Ombudsman offices for proper defense/compromise in the matter.
    Work closely with LOBs, legal heads at locations for smooth operations between teams, documentation, payment approvals etc.


Risk Management: -

  • Work closely with Risk Management to identify the gaps in the processes across various departments and sharing inputs to the risk team for compliance and corrective actions accordingly.
    After passing of Consumer Protection Act, 2019, various new challenges have been pop up including change in pecuniary jurisdiction of District Commission, State Commission, National Commission; Constitution of Central Consumer Protection Authority in Delhi(\xe2\x80\x9c
CCPA\xe2\x80\x9d) etc.
It is crucial and imperative part of job profile to meticulosity review of each consumer litigation, decide detail and proper line of action, review each documents to be produced before courts, sensitize each penal advocate and team periodically; defends the matter on merit, to get maximum success and avoid any negative remark/order.
Responsible to ensure that none of the matter pending before courts attract any negative remark against the company.
Responsible to ensure that none of the matter pending before court attract any negative media reporting which may be jeopardize the interest of the company\xe2\x80\x99s brand value.
Responsible to ensure that none of the award get delay complied to avoid any kind of fine, arrest warrant against company and senior management.
Some of the provisions/power granted to Consumer Courts in relation to fine, arrest, ban on service, investigation etc in Consumer Protection Act 2019 are as under:-


Appeal litigation of specialized claims management: -

  • Monitors reported claims legal cases and interact with key internal/ external concerned parties to initiate appeal and litigation before court including national commission, Supreme Court.
    Analyzes the Appeal reported cases and decisions on filing appeals for all awarded cases, and support teams in preparation of legal arguments (both written and oral) for pleading cases and positioning witnesses
    Confers with legal counsels on claims litigation
    Supports the NORTH ZONE in design of approach & point of view and lead litigation for critical cases which have large impact on business/ involve high stake parties/ require high level liaising with police or govt. official, judiciary and advocates.
    Responsible for settlement of consumer cases and Critical cases Line of action discussions with advocates for getting better results.
    Responsible for the refunds from District Commission, State Commission, National Commission.


Team development:-

  • Participate in selection process to identify the right talent for various positions within the department
    Lead the team and provide advice & guidance on various areas related to arguments formation for cases, evaluation and applicability of precedence etc.
    Establish individual performance expectations and regularly review individual performance of the team
    Provide development opportunities (trainings of new judgments, their impact etc.) for team members to enhance technical knowledge and build domain expertise


Vendor Management:-

  • Effectively engage, build relationships and expand the existing network of advocates in the region for all the courts.
    Address the grievances of the vendor partners, provide trainings on latest developments with regards to legal aspects that impact their area of work as well as the latest developments in BAGIC.
    Negotiate costs, partnership terms as well as scope of work, for best possible arrangement for the services provided.
    Provide and get feedback from the vendors and also efficiently communicate the expectation of the organization for delivery of better and required results.



Management of Writ Petitions pending before High Courts challenging policy decision/Agri business: -

  • To ensure effective management of writ petitions pending before various High Courts challenging policy decision of Govt in relation to insurance specially Agri Business
