Reports to- Litigation head / (GM /B5-1)

Team Direct reportees- Four (Including proposed)

Purpose of your Role
The Senior Manger Litigation is a position with Tata Communications, based in the Corporate Legal team and reporting to the Litigation Head and would be responsible for TS and its subsidiaries within India region.

1. managing litigations before various courts/forums including personal liability/ criminal litigation against senior management.

2. Managing and representing in investigations by various Government and Law Enforcement agencies.

3. managing pre litigation disputes with customers, vendors and any other party.

4. evaluate complex legal and related operational issues and the risk associated with the same and manage such risk.

5. support to key stakeholders for day-to-day business/operational requirements

You will be based in VSB Delhi for operational purpose and shall be responsible for All India.
You will be
The incumbent will have the following role in Tata Communications Limited:

1. Manage the litigations portfolio and support the Litigations Head in litigation and pre-litigation dispute resolution, reporting and record management.

2. Work very closely with external lawyers, internal business stakeholders, and a team of lawyers for litigations / dispute resolutions.

3. The role need to have hands-on approach towards litigation and operations matters and work very closely with the inhouse team.

4. Establish and maintain effective relationship with external law firms, external advocates and senior counsels on a pan-India basis.

5. Manage senior internal stakeholders in Tata Communications and its subsidiary companies for India operations and in associate company of Tata Communications managing data center business in India.

6. Oversee and guide the legal resource/lawyer supporting the payment services business which involve banking laws, contracting and on matters of commercial and criminal laws.

7. Oversee disputes/ litigation in transmission services business of Tata Communications.

8. Significant advisory work on wide areas of law affecting the Company\xe2\x80\x99s operations in India.
You will be accountable for (Key Responsibilities)
The incumbent will have the following responsibilities in Tata Communications Limited :

1. The role is responsible for Litigation and Pre-litigation dispute management, budget management, strategy and advise.

2. To engage with internal and external stakeholders, external law firms and provide day-to-day support to the business teams w.r.t wide area of advisory and litigation work of Tata Communications Limited and its subsidiaries within India region as required and assigned from time to time.

3. Review the draft petitions, suits, Writs, applications, pleadings, prayers before filing the same in discussion with the business teams, the dealing lawyers and external counsels.

4. Significant advisory work on wide areas touching employment laws, labour laws, disputes in real estate, under telecom laws / DoT licenses, matters under the regulated space and before forum in telecom sector (like TDSAT), on environment laws, on criminal legal matters.

5. Manage commercial disputes, criminal legal matters, arbitration matters, investigations, departmental proceedings before labour commissioners, DRI, ED, Customs officials.

6. Contribute planning of legal litigations costs, manage the legal budget and ensure that the litigation expenses are within the agreed budget.

7. Handle and advise on internal policy drafting of various matters having legal import.

8. Manage and advise on critical telecom regulatory litigation pending before TDSAT, High Courts and Supreme Court.

9. Advise the management on various day to day operational matters which require legal view/opinion bearing in mind potential legal and litigation risks.
You will be accountable for (Key Responsibilities)
10. Prepare, review and update litigation / status reports for various internal assessments and for presentation and review by the Board and Audit Committee of Directors in Company\xe2\x80\x99s quarterly meetings.

11. Work closely with multiple internal stakeholders at senior level including with the internal regulatory team, HR team, Finance team, Sales team, payment services business teams.

12. Oversee the custody of litigation and other legal papers/documents for future reference and retrieval.

13. Exhibit high governance standards in all dealings and in engaging with external parties.

You have (Qualification and exp)
Bachelor\xe2\x80\x99s degree in law from a reputed university/institution in India.

He/she should have at least 10 years of post qualification experience in litigation, dispute resolution, advisory matters.

The candidate may have worked in a large law firm as a legal counsel managing Litigation, dispute resolution.

The candidate may have worked in a large corporate set up as in house lawyer managing Litigation, Investigations, dispute resolution.

Experience in handling litigation in telecom matters is desirable but not essential.
You have (Qualification and exp)

Expertise:
Knowledge and experience of at least 10 years in handling high stake litigation specially against sectoral regulators, in commercial disputes, employment / labour law matters before High Courts / Supreme Court and on advising management on diverse operational matters having legal impact.
Strong and thorough understanding of court procedures in various High Courts and in Supreme Court and ability to help strategize potential dispute / litigation.
Should be abreast with the general legal environment and should be able to exercise judgement and discretion to opine on and advise the Management on wide area of legal issues as applicable for the Company\xe2\x80\x99s operations.
