Your Role

Purpose / Mission

As Team Leader - IP your mission is to lead from the front, the IP team of GECIA to deliver & participate in the IP Management while Improving processes and driving the solution-centric approach of GECIA team.

You shall achieve this, by developing the competence of the team and by reorienting the team energy towards Innovation & thereby protecting and maximizing the value of our intellectual property (IP) assets.

About Team

The team consists of IP professionals in GECIA who support in various IP Management processes for Atlas Copco group. They work on various aspects of IP, for example & not limited to:

  • IP analytics
  • Competitive Intelligence
  • IP filing & prosecution
  • IP portfolio management
  • Legal compliance
  • Enforcement & Litigation
Key Responsibilities

Invention Disclosure Assessment and Patentability Searches:
  • Work closely with inventors and research and development (R&D) teams to evaluate and assess invention disclosures for potential patentability or other suitable IP protection.
  • Conduct initial reviews to identify unique aspects of inventions that may qualify for holistic intellectual property protection.
  • Perform comprehensive patent searches to determine the patentability of the invention.
  • Analyze search results to identify existing prior art and potential obstacles to patentability.
Drafting Patent and Design Applications:
  • Collaborate with inventors and technical experts to draft clear and comprehensive patent and design applications.
  • Ensure that patent and design applications meet legal and technical requirements and adequately protect the inventive concepts in close alignment with the Divisional and Business Area wide IP strategies.
Filing and Prosecution:
  • Prepare and file patent and design applications with relevant patent offices.
  • Manage the prosecution process, including responding to office actions, examiner queries, and other communications from patent offices.
  • Become the centre of expertise within the Atlas Copco Group on IP prosecution and practice in Greater India, including Pakistan and Bangladesh.
  • Provide paralegal support services to the Global IP Departments.
Trademark and Copyright Filing:
  • Manage the filing of trademark and copyright applications, ensuring compliance with legal requirements.
  • Work with legal teams to protect the organization\'s brand and creative works.
Global IP Protection:
  • Coordinate international filings and manage the process of securing intellectual property protection in multiple jurisdictions.
  • Ensure compliance with the varying requirements of different patent offices.
Portfolio Management:
  • Develop and implement strategies for the protection and management of the company\'s intellectual property portfolio including patents, trademarks, copyrights, and trade secrets.
  • Maintain and update the IP portfolio database with accurate and current information.
  • Conduct regular audits to ensure the accuracy and completeness of the IP portfolio.
IP Intelligence and Due Diligence:
  • Monitor and analyze competitors\' intellectual property activities to identify potential threats and opportunities, including, but not limited to watch services such as PAIR Watch, Pat-KM, iamip and fovea.
  • Provide insights and recommendations based on competitive intelligence, generate dashboards and reports for business stakeholders and Business Area IP Departments.
  • Conduct landscape analysis to identify trends, emerging technologies, and potential collaboration opportunities within the industry.
  • Provide reports on the IP landscape to support strategic decision-making.
  • Support due diligence efforts for mergers, acquisitions, and partnerships by assessing the intellectual property risks and opportunities associated with potential transactions.
Infringement Monitoring and Enforcement:
  • Set-up and roll-out monitoring activities for detecting infringements on IP assets of Atlas Copco in alignment with Divisional, Business Area and Group Policies and strategies, reporting back to the Atlas Copco Group IP Council.
  • Investigate and analyze potential infringement issues related to the company\'s intellectual property.
  • Support in the enforcement of intellectual property rights, including handling disputes, takedowns and transfers.
Invalidation Searches and Oppositions:
  • Perform comprehensive invalidation searches to assess business case and prepare for pre- or post grant oppositions, invalidations, ex parte re-examinations, inter partes review proceedings or similar, in collaboration with Business Area IP Departments.
  • Draft and file opposition papers with the Indian Patent Office, in close alignment with Divisional and Business Area IP strategies.
Freedom to Operate (FTO) Analysis:
  • Conduct FTO analyses to assess the risk of infringing third-party intellectual property rights.
  • Provide recommendations to mitigate infringement risks.
IP Education and Training:
  • Provide training sessions and educational materials to internal stakeholders on intellectual property matters.
  • Raise awareness about the importance of intellectual property protection within the organization.
Budget Management & Finance support:
  • Manage the budget for the GECIA intellectual property department, ensuring cost-effectiveness and efficiency.
  • Support global IP Departments in invoice handling and financial reporting.
Collaboration and Team Leadership:
  • Work closely with cross-functional teams, including Global IP professionals, R&D, marketing, and business development, to align IP strategies with business goals.
  • Provide training and education on intellectual property matters to internal stakeholders.
  • Lead and mentor a team of IP professionals, fostering a collaborative and high-performance culture.
  • Provide guidance on complex intellectual property issues and cases.
Customer Focus
  • Timely execution of the IP Management for all Business Areas.
  • Create & maintain various Dashboards, KPI to Control, Monitor & Improve the Quality, Delivery, and the cost parameters.
  • Ensure GECIA\'s contribution to improve IP process
  • Ensure dedicated resources / team availability for the customers
People Focus
  • Develop the teams based on the Skills & Competence matrix,
  • Create the Team spirit towards Driving Customer Success & Improving Business Results
  • Instil \xe2\x80\x9cCAN DO; WILL DO\xe2\x80\x9d attitude in the team
  • Help Team members identify their purpose
Process Focus and Operational Excellence
  • Create, Develop & maintain the Knowledge management Portals, Databases, etc. to document the knowledge about and improvement of Product, Process, People & Tool.
  • Create, Develop & Maintain a Resource Planning Mechanism to deliver optimum resource utilization
  • Ensure the Costs per hour remains as targeted by the Group Management
To succeed, you will need

Experience Requirement:
  • Minimum 10 years of experience in IP domain, preferably with engineering degree.
  • People Management experience of handling team will be added advantage.
  • Experience with operational issues.
  • First-hand experience of working on IP management is essential
Knowledge Requirement:
  • Expertise in IP Management.
  • Good knowledge of different IP software & tools
  • Knowledge of Atlas Copco products is must.
