Job Description


Location: Remote Duration: The services are needed for one year with a period of extension of up to one additional year. EXO Position Summary: PMCG is seeking Legal Advisor to support USAID/Libya by providing written and oral advice on questions or problems which affect the successful implementation of USAID/Libya\xe2\x80\x99s programs. The work will include, but are not limited to, the following illustrative issues:
  • Application of Libyan law to a foreign sovereign.
  • Application of Libyan law to USAID/Libya\xe2\x80\x99s partner organizations, both international and local, that carry out activities funded by the U.S. Government through USAID/Libya.
  • Application of Libyan law to local nationals, including Libyan labor and employment
    laws.
  • Application of Libyan law governing issuance of visas to expatriates, and issuance of
    residency and work permits for expatriates.
  • Application of Libyan laws governing financial transactions, banking and transfer of
    funds by USAID/Libya\xe2\x80\x99s international and local partner organizations.
  • Advice or opinions on Libyan governance process and procedure, or other policy matters affecting USAID/Libya\xe2\x80\x99s operations in Libya may also be requested.
Due to the current security environment in Libya, USAID/Libya is a non-presence office operating from
Tunis. Tunisia as part of the U.S. Mission to Libya known as the Libya External Office (LEO) located in the
U.S. Embassy to Tunisia. The political situation in Libya is fluid with internal power struggles posing a risk of influencing governmental actions, including the passage of new laws and regulations, as well as
enforcement of existing laws/regulations in a new manner. During the past year, several incidents have
arisen wherein the enforcement or threat of enforcement of Libyan laws/regulations have directly or
indirectly created challenges to the operations of USAID/Libya activities. At present, USAID/Libya relies to some degree upon the analysis of its partners regarding Libyan law. USAID/Libya believes that the
ability to obtain an independent legal analysis of the implications of Libyan law on the operations of
activities is necessary to effectively respond to existing and future issues moving forward. This would
provide access to legal analysis and opinions from lawyers with expertise in Libyan law and interaction with the Government of Libya that will assist USAID/Libya to navigate such challenges. The Legal Advisor would also provide a new tool for technical support. For example, if the Economic Growth or Democracy, Human Rights, and Governance team needs to understand the implication of a change in the structure or powers of a body within the Government of Libya to assess potential risks or effects to ongoing or contemplated activities, an expert local lawyer could provide an independent opinion within hours. This would be a supplement to, not a substitute for, project technical assistance. Deliverables: Deliverables will generally be provided in the form of written or oral legal opinions or advice, within the deadlines established in connection with each request. All deliverables shall be in the English language unless otherwise requested.
