The Water & Power Division acts as counsel to the Department of Water & Power (DWP), its officers, employees, and the Board of Water & Power Commissioners.

Duties and Responsibilities

The individual appointed to this position will assist the Supervising Attorney in overseeing the section and its work, including serving as acting Supervising Attorney in their absence. The primary responsibilities will include:

Advising and counseling DWP on labor and employment law matters, including: a) providing advice and counsel on state and federal labor and employment law matters, including statutes and regulations governing employee relations, discrimination, civil rights and related matters; b) representing DWP in administrative matters and hearings; and c) other varied and miscellaneous employment-related matters. Interacting with and advising the DWP Board, DWP Executive Management, the Systems (Power, Water, and Joint), and various divisions (Health Benefits, Payroll, Family Care Office, Human Resources, Labor Relations Office, and Equal Employment Opportunity Services.) Reviewing and advising on EEO-related investigation reports and findings; advising on disability-related reasonable accommodation policies and procedures; serving as legal advisor on DWP's Administrative Manual Committee; the Discharge Review Committee, the Investigation Review Committee, and the DWP Board's Personnel Relations Committee; advising on workplace violence matters, assisting with responses to charges of discrimination filed with state and federal administrative agencies; advising on various leave policies; responding to claims filed under the California Government Claims Act that involve employment matters; reviewing and advising on responses to California Public Record Act requests that involve employment records; assisting DWP's Labor Relations Office with grievance arbitrations, unfair employment relation practices (UERP) claims and discipline in civil service commission (CSC) hearings, and handling related writ actions. May participate in daily oversight, supervision, and mentoring of attorneys, paralegals, and staff, assisting with case management and trial strategy, providing guidance and feedback to all employees in the Division, ensuring appropriate staffing assignments, and participating in the management of personnel issues. Other related duties as assigned.

Requirements


----------------

At least 7 years of legal experience in labor and employment law; seasoned judgment and problem-solving skills; demonstrated ability to effectively analyze situations and provide timely well-founded advice and counsel.

Additional requirements include:Knowledge and familiarity with a variety of state and federal laws governing employment, predominantly including: + discrimination, harassment and retaliation arising from Title VII, the Americans with Disability Act (ADA), the Age Discrimination in Employment Act (ADEA), the Fair Employment and Housing Act (FEHA), and 42 U.S.C. Section 1983;
+ state and federal leave laws, such as the federal Family Medical Leave Act, the California Family Rights Act, and state and federal military leave laws arising under the California statutes and USERRA;
+ whistleblower statutes, such as Labor Code sections 1102.5 and 6310;
+ privacy rights arising out of the state or federal Constitutions and the state and federal medical privacy laws.
Strong analytical and reasoning abilities. Outstanding research and writing skills. Demonstrated high level verbal, communication, and advocacy skills. Ability to work as a team with other members of the practice group. Ability to work effectively and professionally with public officials, department personnel, and members of the public. Supervisory experience is desirable but not required.

Current Location


The DWP Division is located at 221 N. Figueroa St., Suite 1000, Los Angeles, CA. Position is subject to assignment at any location of the Office of the Los Angeles City Attorney.

Probation


Appointment to this exempt position (non-Civil Service) will be subject to a two year probationary period as required by Section 1050 of the City Charter. Successfully completing this probationary period will result in tenure with the office.

Classification


Internal applicants: Placement in this position will be as a lateral transfer with the selected candidate assuming the position in their current classification.
