: 1. JOB SUMMARY Invoking the provisions under SARFAESI Act, including taking possession (symbolic/physical) and sale of the secured assets. Conducting/monitoring recovery cases filed by the Bank, including action under section 138 of NI Act. Conducting Legal Audit of all eligible loan accounts as per Policy of the Bank and helping in rectifying the discrepancies as observed in the Audit. Support Vigilance department in resolving criminal cases filed by the Bank. Assistance to branches in resolving legal issues pertaining to various business like Affordable Housing/MSE etc. Drafting/vetting/review of all kinds of credit documentation for MSE and Housing, including security documents and all transaction documents for various kinds of fund based and non-fund based as well as secured and unsecured facilities. Vetting of Title Scrutiny Reports (TSR) submitted by panel Advocates to confirm that the TSR satisfies the business requirements of the Bank. Managing legal issues pertaining to creation/registration of Mortgages, Hypothecation, Pledge etc. 2. PRIMARY RESPONSIBILITIES Business Invoking the provisions under SARFAESI Act - Sending Demand Notices, taking possession of secured assets (symbolic/physical) and sale of the same as per the Act/Rules framed thereunder. Ensuring Legal Audit of all eligible accounts as per Policy of the Bank and follow up for Complete Rectification Certificate from the concerned verticals as regards the observations in the Legal Audit Reports, including appraising the Audit Committee of Board the status of Legal Audit. Support Vigilance department in resolving criminal cases filed by the Bank. Customer Support the secured lending departments in resolving NPA Accounts through measures taken/ to be taken under the provisions of SARFAESI Act (including managing Enforcement Agencies). Support the secured lending departments and Operations department in regard to CERSAI and IBC issues. Co- ordinate with Collections and other verticals for possession and taking action section 14 Applications. Internal process Taking approval from, reporting to and apprising various In-House Committees in regard to the matters touching upon the subjects. Interact with Risk and Credit Dept. for rectifying the deficiencies as observed in their Audit. Assist these Verticals in framing processes/policies relating to SARFAESI and other recovery methods. Learning & Performance Conduct training on relevant laws/acts to target stakeholders on a periodic basis. Keeping a track on the latest laws including SARFAESI Act (and the relevant decisions) affecting MSE and Housing business and proactively advise the business teams about such amendments and its implication on business and to suggest changes in process/procedure. Ensure goal-setting, midyear review and annual appraisal process for self and team members within the specified timelines. Note: Highlight only the critical baseline responsibilities and not activities that the role holder might do on an ad-hoc/on-off case 3. KEY INTERACTIONS Internal Interface External Interface MSE Department and Housing Department at Corporate Office and Collection Dept -Including Authorised Officers under SAFAESI Act. External Legal Consultants, Law firms, Lawyers- Regional Business Managers and Area Credit Managers/Area Managers Statutory and Regulatory Authorities Risk & Compliance Dept. Various Courts of Law Audit Dept. Registration Department/Sub Registrar Offices Vigilance Dept. Business Partners/Service Providers Enforcement Agencies. IBA, Mumbai Sub Registrar Office. Note: Please do not add immediate supervisors/reportees to the list of internal interface 4. PERFORMANCE METRICS BSC Perspective Key Result Areas Key Performance Index Financial/Business Bottom-line Economic loss to the Bank due to non-adherence to legal requirement, like not taking timely action under SARFAESI Act. Undue delay in obtaining Orders from DM etc. (Target - zero economic loss) Customer Retention/TAT/ Friendly Approach . Quality of Work . Intimacy . Operational Excellence . Delivery Internal Process Regulator, District Magistrate/CJM Court and other Forum satisfaction No of instances of non-compliance with legal requirements. (Target - zero instances) Operational efficiency Percentage of adherence to timelines while dealing with cases under SARFAESIAct. Learning & Performance Capability building Knowledge repository creation on legal requirements. Performance management Adherence PMS timelines for self. Note: Each BSC perspective can have multiple KRAs. Each KRA can have multiple KPIs
